Terms and conditions governing your use of the Bernstein platform

Description of the Service

IP LEVERAGED SAS ("Bernstein") operates bernstein.io, a platform where registered users upload files and texts organized into "innovation units" representing intellectual property assets. The service provides encryption, storage, retrieval, and sharing tools. Encrypted units are stored on Bernstein servers. Decrypted units are never sent or stored on Bernstein servers. Users can generate digital certificates through blockchain registration or EU Timestamping Authority submission without revealing content — only cryptographic fingerprints are used. The service is provided "as-is" with no responsibility for data timeliness, deletion, or storage failures.

Acceptance of Terms

By using the site and service, users agree to be bound by these Terms and the Privacy Policy. Users must be at least 18 years old under French law or have parental consent. Organizational users confirm authority to bind their organization to the agreement.

Modification of Terms

Bernstein may modify these terms at its sole discretion and will notify users of material changes. Using any service shall constitute your acceptance of the terms as modified. Service availability may be interrupted for maintenance or other reasons. Bernstein reserves the right to suspend services without notice or liability.

Registration

Users must create accounts with an email address, password, and encryption key. Registration information must remain accurate and current. Bernstein is not aware of your encryption key and is unable to access, change, reset, or revoke your encryption key. Users are solely responsible for credential confidentiality. Loss of encryption keys results in permanent data loss — it is not possible to decrypt already existing encrypted units.

User Conduct

Account holders are responsible for all submitted content. Users must not upload content they lack rights to share, content infringing intellectual property rights, or content violating laws. Users agree not to interfere with service infrastructure or access the service through unauthorized means. Abuse reports should be sent to [email protected].

Release and Indemnity

Users release Bernstein from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims, and demands. Users indemnify Bernstein against claims arising from term breaches, posted content, service use, or third-party rights violations.

Trademarks

Bernstein trademarks and logos cannot be used without written consent. Bernstein-originated content such as text, graphics, logos, data compilations, APIs, and software is protected by French and international copyright laws.

Cancellation and Termination

Users can cancel their accounts at any time through the web interface. All innovation units will be immediately deleted from the service upon cancellation. Unused paid periods are not refunded. Expired subscriptions result in frozen credentials until deletion or renewal.

Miscellaneous

Users cannot assign their rights under these terms. The law of the French Republic applies to these Terms. Jurisdiction is Strasbourg, France. If any provision is found to be invalid, the remaining provisions remain enforceable. In the event of any conflict between language versions, the English version shall prevail.
